Terms of Service

GlowUpKit ("we," "our," "us," "the Company")

These Terms of Service ("Terms") govern your use of the GlowUpKit mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 13 years old (or 16 in the EEA/UK, or the age of digital consent in your jurisdiction) to use the Service.
• If you are between 13 and 18, you must have parental or guardian consent.
• By using the Service, you represent that you meet these age requirements.

2. The Service

GlowUpKit is an AI-powered beauty analysis app that provides:

• Seasonal color analysis based on your selfie
• Skin appearance analysis and scoring, for beauty guidance only
• Personalized makeup and skincare recommendations
• AI-generated before/after glow-up images (premium feature)
• Product recommendations

3. Your Account

• You must provide a valid email address to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at support@glowupkit.app if you suspect unauthorized access.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Your Content

4.1 Ownership

You retain full ownership of all photos you upload to GlowUpKit. We do not claim ownership of your content.

4.2 License You Grant Us

By uploading a photo, you grant us a limited, non-exclusive, non-transferable license to:

• Process your photo to generate color analysis, skin analysis, and glow-up images
• Store your photo securely in your private account
• Send your photo to our AI processing partner (Google Gemini) solely to fulfill your analysis request

This license terminates when you delete your account or the specific photo/scan. We do not use your photos to train AI models, for marketing, or for any purpose other than providing the Service to you.

4.3 Content Restrictions

You agree not to upload content that:

• Contains images of other people without their consent
• Is illegal, harmful, threatening, abusive, or harassing
• Contains nudity or sexually explicit material
• Infringes on any third party's intellectual property rights
• Contains malware, viruses, or malicious code

5. AI-Generated Content

• Glow-up images and analysis results are generated by artificial intelligence and may contain inaccuracies, artifacts, or unrealistic representations.
• AI-generated images do not represent a guaranteed outcome of any cosmetic procedure or product.
• You may use AI-generated glow-up images of yourself for personal, non-commercial purposes (sharing on social media, personal reference).
• If you believe an AI-generated image is harmful or inappropriate, you can report it by contacting support@glowupkit.app from within the app or directly, and we will review and remove it promptly.
• We retain a license to use anonymized, non-identifiable analysis data (e.g., aggregate statistics about color season distribution) to improve the Service.

6. Subscriptions and Payments

Prices may vary by app store and are subject to change. Current prices are always displayed in the app before purchase.

6.3 Billing and Renewal

• Subscriptions are billed through Google Play Store or Apple App Store.
• All subscriptions are auto-renewing. Your subscription will automatically renew at the end of each billing period (weekly or annual) unless you cancel at least 24 hours before the renewal date.
• There is no free trial — premium access begins immediately upon purchase.
• You can manage or cancel your subscription in your device's app store settings (Google Play > Subscriptions or iOS Settings > Subscriptions).
• Cancellation takes effect at the end of the current billing period. You retain premium access until then.

6.4 Refunds

Refund requests are handled by Google Play or Apple App Store according to their respective refund policies. We cannot process refunds directly. If you believe you were charged in error, contact support@glowupkit.app and we will assist you.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law
• Attempt to reverse-engineer, decompile, or extract source code from the app
• Use automated scripts, bots, or scrapers to access the Service
• Circumvent rate limits, paywalls, or security measures
• Impersonate another person or misrepresent your affiliation
• Use the Service to harass, abuse, or harm others
• Upload photos of other people without their explicit consent
• Redistribute, resell, or sublicense any part of the Service

8. Intellectual Property

• The GlowUpKit app, brand, logo, design system, and underlying technology are owned by the Company and protected by intellectual property laws.
• The 12-season color analysis methodology, UI design, and AI processing pipeline are proprietary.
• Product recommendations may include affiliate links. We may earn a commission from purchases made through these links at no additional cost to you.

9. Disclaimers

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 AI Accuracy

We do not guarantee the accuracy, completeness, or reliability of AI-generated analysis results, skin appearance scores, color season classifications, product recommendations, or glow-up images. Results may vary based on lighting, photo quality, and other factors.

9.3 Third-Party Products

Product recommendations are generated by AI for cosmetic guidance purposes and may not be suitable for all skin types, conditions, or allergies. Always check product ingredients and consult a professional before using new skincare or makeup products. We are not responsible for adverse reactions to recommended products.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• The Company's total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $50 USD, whichever is greater.
• Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third party's rights
• Content you upload to the Service

12. Termination

• By you: You may delete your account at any time in-app (Settings > Delete Account) or via glowupkit.app/delete-account. This permanently removes all your data within 30 days.
• By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Service. We will notify you by email with the reason for termination.
• Effect: Upon termination, your license to use the Service ends. Data deletion follows our Privacy Policy.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. For users in the EEA/UK, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

13.2 Dispute Resolution

Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the Indian Arbitration and Conciliation Act, 1996, with the seat of arbitration in India.

Exception: Users in the EEA/UK retain the right to bring proceedings in their local courts. Users in the UAE/Saudi Arabia may bring claims before the competent courts in their jurisdiction as required by local law.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via in-app notification or email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree, you must stop using the Service and delete your account.

15. Miscellaneous

• Severability: If any provision of these Terms is held invalid, the remaining provisions remain in full force.
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service.
• Assignment: You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets.
• Language: These Terms are provided in English. If there is a conflict between the English version and any translation, the English version prevails.
